FlagHawk App – End-User License Agreement (EULA)

By downloading, installing, or using the App you accept this EULA.
If you do not agree, delete the App and do not use it.

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect information, including data sent to third-party service providers such as Anthropic, Supabase, and PostHog.

1. License

ZavSoft LLC grants you a personal, non-transferable, revocable license to install and use FlagHawk on devices you own or control for your own technician work.

2. Subscription, Free Trial & Auto-Renew (Apple / Google)

  • Pick-Your-Price. During sign-up you choose a monthly price within the tiers offered by the app store.
  • Free Trial. 7 days free → then the price you selected auto-renews monthly until cancelled.
  • Billing. All payments are processed by Apple App Store or Google Play. ZavSoft never sees your card number.
  • Cancel any time in the App Store / Play Store subscription settings. Cancellation takes effect next billing cycle. Fees already paid are non-refundable except as required by law or the store’s policy.

3. User Content & Your Representations

You retain ownership of photos and RO data you upload. You grant ZavSoft a license to store and display that content as needed to operate the App.

You represent and warrant that you have the right to capture, upload, and submit any content you add to the App, including photos of repair orders. You are responsible for complying with your employer’s data-handling policies, confidentiality agreements, and any applicable law (including but not limited to the Gramm-Leach-Bliley Act and applicable state privacy laws) regarding customer information that may appear in content you upload.

4. Acceptable Use & Employer Policies

You acknowledge that use of the App does not override obligations you owe to your employer. You are solely responsible for ensuring your use of features — in particular the Scan Repair Order feature — complies with your employer’s written policies regarding customer data handling, photography of customer records, and confidentiality.

5. Prohibited Conduct

  • No reverse engineering or scraping;
  • No uploading unlawful or offensive content;
  • No uploading content you do not have the right to capture or submit;
  • No sharing login credentials.

6. Third-Party Services

The App relies on third-party service providers, including Supabase (data storage), PostHog (analytics), and Anthropic (AI processing for the Scan Repair Order feature). Your use of these services through the App is also subject to their respective terms and privacy policies. See our Privacy Policy for details on how each provider handles your data.

7. AI-Generated Output

Features that use artificial intelligence — including the Scan Repair Order feature — may produce inaccurate or incomplete results. You are solely responsible for reviewing and verifying any AI-extracted data before relying on it or saving it to your records. ZavSoft makes no warranty that AI-generated output will be accurate, complete, or suitable for your purposes.

8. Disclaimers & Limitation of Liability

THE APP IS PROVIDED “AS IS.” ZavSoft’s total liability will not exceed US $100. Indirect or consequential damages are excluded to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless ZavSoft, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • your violation of this EULA;
  • your violation of any law or the rights of any third party — including but not limited to your employer’s policies or any customer whose information appears in content you upload to the App; or
  • any content you upload to the App, including repair-order images captured using the Scan Repair Order feature.

10. Dispute Resolution & Governing Law

  • Informal first – email help@zavsoft.com.
  • Arbitration. Unresolved disputes → binding arbitration remotely via videoconference under JAMS Rules. If an in-person hearing is required, venue will be in California as mutually agreed (or as JAMS designates). No class actions.
  • Law. California law governs.

11. Termination

ZavSoft may suspend or terminate access for breach. On termination you must delete the App and all backups.

12. Changes to this EULA

We may update terms with 30 days’ in-app notice. Continued use = acceptance.
